A: The Occupational Safety and Health Administration (OSHA) can impose both civil and criminal penalties on construction employers who fail to abide by the legally required safety standards. Civil penalties are typically fines and are based on the amount of harm caused by the employer's noncompliance with the relevant safety standard, whether the employer made a good-faith attempt to comply with the standard, and the employer's history of safety violations. Criminal penalties may be imposed if there was a willful violation that resulted in death, if someone harmed or interfered with the work of an OSHA inspector, or if false information was provided to an inspector. The maximum criminal penalty is six months in jail.
It is important to note, however, that your employer's noncompliance with safety standards may also be relevant evidence in a civil or criminal trial brought based on the injuries incurred in a construction-site accident.
