    I settled my case for a confidential amount of money prior to trial. I was a dockbuilder  injured when I fell from an elevated work platform onto the deck of a barge on a   construction project. The elevated work platform was inadequate, it was not secured, it did not have railings and did not protect me from elevation related hazards.     Dockbuilder employed by EIC Associates construction company was working upon a materials barge and was caused to fall from stack of steel walers he was trying to separate with a peevee because a crane was unavailable to pick the load of walers. No fall protection not provided.  Project was building new Ikea store in Gravesend Brooklyn at old New York Shipyard. Plaintiff asserted violations of New York Labor Law Sections 240 and 241(6) against property owner Ikea and contractor Aurora Construction.  Plaintiff lost two years of employment recuperating from two surgeries. He has returned to work as a supervisor. Just before trial, case settled for over $1,050,000 total value, consisting of “new money” of $787,500 and waiver of Longshore Harbor Workers Compensation Act (LHWCA) lien of $270,000.
