Symptoms of Broken Ribs After Slip and Falls

If you've been hurt in a slip and fall accident, New York and New Jersey property owners and managers may be liable for your injuries. However, in order to recover the payment that you deserve, you need to seek medical attention and document your injuries and the impact that the injuries are having on your life. If you experience any of the following symptoms, then your injury may be more significant than bruised or cracked ribs. Symptoms of broken ribs, which are a serious and potentially life threatening medical condition include*:

How Your Hip Fracture Could Have Been Prevented

Approximately 75% of people who suffer hip fractures will not make a full recovery. What's worse is that in many cases the hip fracture could have been prevented in the first place.About 90% of hip fractures occur because of fall accidents. While, sometimes, a fall is an unforeseeable accident, other times the fall that caused the injury could've been prevented. For example, if a building owner or manager knew that a floor was slippery and failed to warn guests or customers, then the building owner or manager could be liable for the injuries. This would also be true if a hand railing was broken and not fixed or if a stairwell was poorly lit and a person fell and got hurt.In order to determine if your hip fracture could've been prevented, it is important to understand the cause of your accident and whether the building owner or manager knew or should have known about the cause. The New Jersey and New York slip and fall attorneys of Hofmann & Schweitzer will investigate the cause of your accident and whether or not the condition should've been known about and fixed by the property owner or manager. If your slip and fall hip fracture injury could have been prevented, then we will help you recover damages.Contact a New York and New Jersey premises liability lawyer today for more information. Why the Railroad Wanted to Make Carpal Tunnel Syndrome Your Fault

You've been a loyal employee. So loyal in fact that your job responsibilities have caused you to suffer the painful and significant condition known as carpal tunnel syndrome. You want to trust that the railroad to which you've been so loyal will return that loyalty and pay you the damages that you deserve for your work related injuries.Historically, many railroads have failed to match the loyalty of injured workers. Instead, over the past decade there have been instances where railroads have surreptitiously taken DNA samples from workers and, without the consent of the workers, have sent the samples out for genetic testing. The purpose of the genetic testing was to attempt to prove that the workers were predisposed to developing carpal tunnel and to avoid paying damages to injured workers. If you suspect that your employer has conducted genetic testing without your consent, or if you have suffered damages related to your carpal tunnel syndrome, then we encourage you to contact an experienced New York and New Jersey railroad lawyer to discuss filing a FELA carpal tunnel claim. We will fight to protect your rights. Call us at 1-800-362-9329 or contact us via our online contact form for more information about how we can help you recover from your railroad workplace injury.

How do Diesel Exhaust Fumes Harm Railroad Workers?

Understanding what diesel exhaust fumes are and how they can potentially hurt New York and New Jersey railroad workers is important to preventing serious injuries and fatalities. Please read this blog post for more information and please contact a New Jersey injury lawyer at 1-800-362-9329 or via our online contact form to discuss your case.

How do Diesel Exhaust Fumes Harm Railroad Workers?

According to the Occupational Health and Safety Administration (OSHA), the major components of diesel exhaust include dangerous substances such as carbon dioxide, carbon monoxide, nitrogen oxide, nitric oxide, and sulfur dioxide. Other minor yet dangerous components are also present and place New York and New Jersey railroad workers at risk of serious respiratory injuries, cancers, and other illnesses. OSHA suggests that proper training of engine operators, maintenance of diesel engines, and precautions can help reduce the dangers for railroad workers.Unfortunately, railroads don't always take the necessary steps to protect their workers, and tragic consequences can result from repeated exposure to these dangerous fumes. If you are a New York or New Jersey railroad worker who has suffered an occupational illness because of diesel exhaust, or if you are the survivor of a railroad worker who has died because of diesel exhaust, you may be entitled to damages. Please contact a New Jersey injury lawyer for more information about your specific case. The New York and New Jersey railroad attorneys of Hofmann & Schweitzer would be happy to answer your questions and help you with your recovery. How to Prevent New York and New Jersey Railroad Crossing Accidents

The plan includes various measures that the government and others can make immediately and for the long term to prevent accidents at highway rail crossings. Some of the measures discussed in the plan include:

Attention Railroad Workers: How to File a Complaint and Recovering Damages for Retaliation

Railroad employers do not always do the right thing. Sometimes they retaliate against well-meaning workers who report potentially dangerous conditions using the proper procedures or workers who seek to follow reasonable medical treatment. If this has happened to you, the Federal Rail Safety Act provides you with a way to file a complaint. ANew York accident attorney can help you file a complaint and pursue justice if you have suffered financial or medical damages as a result of the railroad's actions.Complaint Procedures

Complaints must be filed within 180 days of the alleged retaliation. The complaint should be filed with the OSHA office that has jurisdiction over the area where the worker lives or works. Once a complaint is filed, OSHA will conduct an investigation. If the evidence supports your claim of retaliation, OSHA will then try to encourage a settlement. If a settlement cannot be reached, OSHA may order that the railroad provide you with relief. Relief may include reinstatement, back pay, and punitive damages up to $250,000.For more information about how to pursue a railroad whistleblower complaint or obtain relief after retaliation, please contact a New Jersey or New York railroad attorney at Hofmann & Schweitzer. New Report Finds MTA Signal Inspectors Frequently Failed to Do Their Jobs

According to a report recently issued by the MTA, subway signal inspectors "frequently" failed to perform the required inspections and repairs on New York City subway signals. Not only did the inspectors fail to do their jobs, but their managers failed to supervise them and falsified reports that were filed with the agency. An MTA Board Member told the Wall Street Journal that the report's findings are "enormously disturbing."* The New York City Transit President has called the report "a very serious issue."*

What Will the MTA Do in Response to the Report?
The MTA reports that it is considering changing the way signal inspectors do their jobs. Lines may be temporarily shut down, and the size of each signal inspection team may be increased. The MTA's inspector general is continuing the investigation; the agency has not yet decided on the consequences for employees who falsified reports. What Should You Do if You're Hurt in a New York Subway Accident?

If you are a subway signal inspector who is injured in a work related accident, it is imperative to contact a New York railroad attorney to discuss your rights. Likewise, if you are a subway passenger who has been injured in an accident, it is important to contact a New York railroad lawyeras soon as possible.
