New York Scaffold Law: Pros and Cons

From a young age we are taught that there are two sides to every story, but that doesn't mean that we have to support both sides of every story. Sometimes, as may be the case with the New York scaffold law, it is possible to either support the law as it is or support its amendment or repeal. Before you can make an informed decision about where you stand, however, you need to understand the arguments for and against the current law that allows New York construction workers injured in scaffolding accidents to recover for falls even if they were negligent or caused their own injuries.

Arguments Against the New York Scaffolding Law

Some people argue that the current law:

  • Is unfair - New York is the only state in the nation with this type of statute.
  • Is expensive - Arguably, it adds considerable insurance costs to every New York construction job.

Arguments in Support of the New York Scaffolding Law

Some people argue that the current law:

  • Is important to protecting workers safety.
  • Fairly allows injured construction workers to sue contractors and property owners for punitive damages, pain, and suffering. These damages are not allowed pursuant to the workers' compensation system.
