RAILROAD TRACK BALLAST CAUSED INJURIES

Claims related to railroad ballast injuries, wherein workers suffer micro-traumas unrelated to any particular incident, to their joints, particularly of the legs (ankles, knees, hips, feet), have become more common as the science of ergonomics over the years has developed. and identified the risks related to walking on uneven ballast surfaces. Indeed, many railroads, such as the Union Pacific Railroad, have created special task forces to identify the hazards of repetitive motion traumas, with the intent to reduce the hazards and risks related thereto. Many workers have filed lawsuits against their employers alleging that they have developed serious and sometimes permanent injuries as a result of improper ballast in railyards. Recently, a jury in Maryland awarded eight railroad workers a total of $15.1 million in their railroad ballast injury lawsuit against CSX Transportation Inc., the railroad company for which they worked. Many of the workers who suffer from these painful injuries must undergo painful surgeries, such as total knee replacements, ankle fusions and hip replacements.

The law firm of Hofmann & Schweitzer currently is aiding FELA employees of the Long Island Railroad who assert cumulative trauma to their knees, ankles, hips and feet from long time exposure to walking and working on unsafe railroad ballast in maintenance and repair yards, from boarding and disembarking trains while moving and other cumulative traumas.
