Paul Hofmann, Secretary to the Maritime Torts Section of the Maritime Law Association of the United States ("MLA"), participated in a Point-Counterpoint discussion of the CSX Transportation v. McBride case before the Supreme Court. This important appeal will decide whether the Courts will follow, and will instruct juries to follow, the Congress's express statement that a Jones Act seaman injured through his employer's negligence (and a FELA railroad worker similarly injured) shall collect damages for those injuries if the employer's negligence, in whole or in part, no matter how slight, in causing the injury. Taking the "plaintiff's" side of the issue, Mr. Hofmann advocated that the courts should apply the standard as written by Congress in statutes, and not apply some more difficult or hard to attain standard.
