Are You Safe in Your New York City Apartment?

Posted on May 16, 2011

According to a recent investigation, about 20,000 complaints are filed against New York City landlords each year for creating potential firetraps by dividing apartments into smaller living spaces. The complaints have been received by the New York City Buildings Department against landlords throughout the City, most notably in Queens and the Bronx.

The complaints allege that illegal apartments have been created in certain buildings. According to the recent investigation, the City has done little to pursue the allegations or to ensure the safety of the tenants. Last year, the City only gained access to about 45% of the buildings against which allegations were made. In 2006, that rate was 60%.

On April 25, 2011, three people were killed in a fire in one of these illegally converted apartments located in the Bronx. While the details of that fatal fire are still emerging, it is clear that illegal apartments put tenants at risk. Residents may not be able to escape a fire if their apartments do not comply with local building codes, and landlords may be endangering the lives of their tenants.

We extend our sincerest condolences to the families of those killed in the April 25 fire, and we hope that New York City landlords will realize the grave risks they are creating and stop creating illegal apartments.
