Yet, as you are welding, dangerous metals and gasses are released into the air. It is an efficient way to get through stone, brick, or concrete. However, silica may be among the particles released from the stone, brick, concrete, or other substance that you are jackhammering. Accordingly, it is important to protect yourself from inhaling the silica so that you can do your best to prevent the development of serious lung diseases such as silicosis.

Protection from Silica Exposure

According to the Occupational Safety and Health Administration (OSHA), the best way to protect yourself from silica inhalation and silica-related diseases is with wet silica dust control methods. For example, it might be helpful to wet the surface before jackhammering into it so that the dust is controlled and less dust is released into the air. This is effective when the water mist is continually sprayed into the spot where the jackhammer is operating. Even with wet silica dust control, respiratory protection is also important, in case any dust particles are released into the air. Respiratory protection may include respirators and are especially important when working in an enclosed space or in an area with multiple jackhammers.

Call a New Jersey Construction Injury Attorney if You’ve Been Hurt

If you have developed silicosis or another respiratory disease after working on a construction site, then it is important to contact an experienced New Jersey construction lawyer for more information about your possible recovery. It is part of your job. If you aren’t willing to lift heavy materials and/or equipment, then it could be difficult to find work in the construction industry. However, just because it is part of your job does not mean that there aren’t risks involved. Heavy lifting can cause serious injuries. It is important to be aware of those injuries so that you can get the medical and legal help that you need to recover.

7 Possible Injuries Caused by Heavy Lifting

As a construction worker, it is important to know about two different kinds of injuries. One type of injury is acute, meaning that it happens as the result of one specific incident. The other type of injury is cumulative and occurs because of repetitive activities that you do over time. Whether your injury is acute or cumulative, you may suffer harm to your:

Back.

Wrists.

Muscles.

Elbows.

Spine.

Hands.

Feet.

Whether these injuries happen suddenly or over time, the effect may be the same. In 2009 the U.S. Supreme Court decided that any employer not taking care of staff illnesses would be fined and expected to pay sick crewmembers. Additionally no ocean marine programs are allowed to cover these costs; therefore the money would be coming directly out of the employer’s pocket.

The case that yielded this verdict in June 2009 was Atlantic Sounding Company v. Townsend, where a crewmember claimed that he was sick and was disregarded by his employer when he asked for reimbursement towards his medical bills. According to maritime law any crew person that is working aboard a vessel is entitled to medical care, and compensation should they be injured or fall ill. Shore-based employees however, are only compensated and cared for should they suffer an injury.

These general maintenance and cure laws of the sea are not new. They have been around for hundreds of years, and have been considered rules of the sea since the times where trading ships would sail for periods consisting anywhere from months to years. The whole point of these laws was to keep the vessels working without allowing anything to get in the way.

If you are a crewmember and have fallen ill, or have been injured, the agent will then file a claim under the vessel’s P&I insurance.

If you or a loved one has suffered an injury in a maritime accident, please contact: Hofmann & Schweitzer at 1 (800) 362-9329 (1-800-3-MAY-DAY)http://www.hofmannlawfirm.com/contact.cfm

Understand Your Rights if Your Hand is Hurt on an NY Construction Site

The injury has already happened. Your actions alone can’t prevent all construction accident injuries, but you can help reduce the risk by getting enough sleep, by going through all of your safety checklists as often as required, and by keeping an eye out for dangerous conditions.

Promptly report dangerous conditions to your employer. This will give your employer the chance to fix the problem before you, or someone else, is hurt.

Additionally, you should make sure that your doctor has provided you with the necessary medical clearance to return to work so that you know that you are physically able to do your job safely.

Call a New York Construction Accident Attorney if Disaster Strikes Twice

Unfortunately, the reality of construction work is that you can be hurt at any time even if you try to prevent an injury. Earlier this month, a Boston construction worker fell from scaffolding outside an apartment building that was under construction on Commonwealth Avenue. When the worker fell, he became entangled in the plastic sheeting that was protecting the exposed building from the elements. The plastic sheeting ended up forming a bubble around him and cushioning his fall. He survived the 30-foot construction fall with non-life threatening injuries.

Plastic Sheeting Was Never Intended to Protect Him

While this construction worker was fortunate, the plastic sheeting was never meant to be a safety precaution for falling workers. Instead, it was a fortunate accident and not one that construction workers in New Jersey, New York, or even Boston should ever count on happening again. More traditional safety precautions such as harnesses, railings, and protective gear are better equipped to prevent serious accidents.

Call a New Jersey Construction Accident Lawyer if You’re Hurt

If you have been hurt in a fall (with or without the benefit of an accidental safety net such as plastic sheeting), then it is important to contact an experienced New Jersey construction lawyer as soon as possible. While your employer may mean you no harm, the information may not be readily shared with you. Our New York construction accident attorneys do not believe that your employer should have access to important information that you do not have because it simply isn’t fair.

Here’s the Secret

There may be quite a bit of information that your employer does not automatically share with you following an accident. However, one of the biggest secrets may be that you could be entitled to compensation even if your employer was not negligent. Additionally, you may be entitled to compensation even if you were negligent.

New York worker’s compensation law is a no-fault insurance program. That means that you should be able to recover for your medical expenses and possibly a portion of your lost income and other damages regardless of whether you or your employer were negligent in causing the accident.

Call a New York Construction Accident Attorney If You’ve Been Hurt

If you have been injured in a recent New Jersey or New York construction accident, then it is important to find out all about your legal rights from an experienced New York construction accident lawyer who is committed to helping you. Experienced workers know what they are doing. They may be better able to do their jobs safely and quickly then less experienced workers are able to do, and their supervisors may be able to trust them with more complicated tasks.

With These Benefits Come One Important Risk

A worker’s experience may benefit his or her employer and may allow a worker to earn more money, but an experienced worker is also, generally, an older worker. The worker’s body is not the same as it was decades ago when he first began gathering this valuable experience. Accordingly, when a construction accident occurs, an experienced worker may suffer more significant injuries than a younger worker.

Recovering From an Injury

As an experienced construction worker, you have the same right to a potential recovery as a younger worker would have if he was hurt on the job. That means that you should be able to recover for the specific injury that you suffered. Your benefits should not be reduced simply because your age was a factor in how badly you were hurt.

For more information about your potential recovery or to get started protecting your recovery, we encourage you to contact an experienced New York construction accident attorney today. It is likely a situation that you have never been in before, and it is certainly a situation that is traumatic and possibly chaotic. It is difficult to know what to do and what to say if you are able to do or say anything at the time that you are hurt. If you are able to communicate, however, there are a few things that it is better not to say.

3 Things Not to Say

If possible, try to avoid saying:

It’s okay. I’m not hurt. I am fine. You just don’t know this yet.

I can keeping working. I don’t need medical attention. Some injuries may not be readily apparent, and it is best to see a doctor for a full examination after your accident.

I won’t contact a New Jersey construction accident lawyer. You may need a New Jersey construction accident attorney to help you after your injury.

While it is best to avoid these statements, you may still be able to make a fair recovery even if you said them, or something similar, at the time of your accident.

Call a New Jersey Construction Attorney to Learn More About What to Do Next

If you have already been hurt then you can’t go back and change what happened, but you can control your future.
