On June 27, 2010, six-month-old Gianna Riccuitti went to the Central Park Zoo. As the infant and her mother were posing for a picture, a tree limb fell, killing Gianna and critically injuring her 33-year-old mother Karla DelGallo.
Now, Gianna’s family is filing a lawsuit against New York City, the Central Park Conservatory, and the Wildlife Conservation Society. The lawsuit seeks $50 million in damages.
New York City outsources much of its Central Park tree maintenance work to the Central Park Conservatory. However, this particular tree’s roots were within the limits of the Central Park Zoo which means that maintenance of the tree may have been within the jurisdiction of the Wildlife Conservation Society.
In the days following this tragedy, there was confusion over who was responsible for the tree, and the City was unable to identify when it had last been inspected and maintained.
While a property owner is not liable for an Act of God, a property owner may be liable for a tree related injury if the danger was known or should have been known and was not acted upon.
