Falls are a constant hazard on construction sites, but roofers are particularly at risk of slipping, losing their balance, or falling several stories. State law requires construction sites to provide roofers with fall protection—and if these measures weren’t followed, workers can pursue a construction injury claim against the negligent party.
Safety Measures to Protect NY Construction Workers During Roofing
Owners and contractors are required to make construction sites as safe as possible for workers under NY Labor Law 241. Section 241(6) of this law compels owners and 
contractors to comply with any rules made by the Commissioner of the Department of Labor to carry out the provisions of the law.
The Department of Labor has created specific construction safety rules, including Part 23 of the New York Industrial Code. Part 23-1.24 sets forth the following guidelines for any roof construction, repairs, or maintenance:
Roofing brackets.
Secure roofing brackets must be used to provide a level working platform if the roof has a slope steeper than one in four inches (unless crawling boards or compliant safety belts are used).
Crawling boards.
Crawling boards of at least 10 inches in width and one inch in thickness must extend from the ridge poles to the eaves. These must be properly secured to the roof and have a compliant lifeline strung beside each crawling board.
High and steep roofs.
Any work on a roof more than 20 feet in height with a slope greater than one in four and without a parapet at least two and one-half feet must protect workers by approved safety belts or a scaffold. A compliant, ground-supported scaffold of sufficient width to extend outward at least two feet from the exterior roof edge must be installed and include roofing brackets or crawling boards to protect against sliding.
Hot luggers.
Closed containers or devices used for transporting molten roofing materials must have an adequate safety latch over the fill pipe cover and be vented or constructed to prevent the accumulation of gas. Manufacturers of these transporters must provide written operating and safety instructions for proper operation.
