Who can be held responsible if I got lead poisoning on a construction site?

Parties That May Be Liable for Lead Poisoning in Construction Work

Painters and demolition crews are at the highest risk for inhaling or swallowing lead particles, but anyone involved in blasting, sanding, scraping, or grinding lead-painted structures could be exposed to lead on a construction site. While workers are barred from suing their employers, they can hold other parties accountable for the costs of their injuries.

Workers who suffer lead poisoning may be eligible to file third-party injury lawsuits against:

• Site owners. An owner who is actively involved in the day-to-day site operations may be liable if workers don’t have adequate hand-washing stations, showers, and break rooms. They should also ensure that changing rooms and eating areas are kept clean to prevent workers from ingesting lead or carrying lead particles home on their clothing.
• General contractors. Site managers should ensure that safe work practices are used and that protective equipment (such as respirators) is provided. They also have a duty to test the air for lead, provide regular blood lead tests, and remove any employees from lead work if they have a blood lead level of 40 mcg/dL or higher.
• Subcontractors. Any worker who is exposed to lead or shows symptoms of lead poisoning should be seen by a medical professional for blood tests. A third party may be liable if the worker is not tested or the examiner fails to detect lead poisoning.
• Product manufacturers. A manufacturer could be held liable for defects in respirators, protective clothing, or testing kits.
